Gestational vs. Traditional Surrogacy

Understanding the difference so you can make the right choice for your journey.

When you begin exploring surrogacy, it’s normal to come across terms that feel technical or confusing. Two of the most common are gestational surrogacy and traditional surrogacy. While they may sound similar, they are very different in how they work emotionally, medically, and legally. At The Surrogacy Family, we work exclusively with gestational surrogacy, and here’s why:

Gestational Surrogacy

In gestational surrogacy, the surrogate (also known as the gestational carrier) does not have a genetic link to the baby. The embryo is created using either the intended parents’ or donors’ egg and sperm through IVF (in vitro fertilization), and then transferred to the surrogate’s uterus. This means the surrogate is carrying a baby for someone else, but she is not biologically the mother. It’s the most common and widely accepted form of surrogacy in Colombia and internationally, both medically and legally.

Traditional Surrogacy

In traditional surrogacy, the surrogate’s own egg is used, meaning she is genetically related to the child. Fertilization typically happens via IUI (intrauterine insemination) instead of IVF. While this form of surrogacy may exist in theory or in the past in some countries, it raises complex emotional, ethical, and legal challenges, especially around parental rights, attachment, and custody. For this reason, traditional surrogacy is not allowed or practiced in Colombia.

Why This Matters?

Choosing gestational surrogacy allows for clear legal agreements, emotional boundaries, and focused support for both parties, the intended parents and the surrogate. It helps create a foundation of trust and respect throughout the journey.

Why does Colombia only allow gestational surrogacy?

The legal, ethical and medical reasons behind this decision

Legal clarity from the beginning

Since there is no genetic link with the gestational carrier, the legal affiliation of the baby is clearly defined in favor of the intended parents.

Emotional well-being of the pregnant woman

Emotional complexity and possible conflicts are avoided as there is no biological connection with the baby, protecting the psychological well-being of the gestational carrier.

International standards

Colombia follows practices recognized by advanced legal systems, aligned with international ethical and medical frameworks.

Guaranteed medical ethics

The process is carried out through specialized clinics under strict protocols that prioritize respect, informed consent and human rights.

In Colombia, gestational surrogacy is the only permitted modality, and is carried out exclusively in authorized assisted reproduction clinics, under rigorous medical and legal protocols that guarantee the safety, ethics and rights of all parties involved.
